• Provide, operate, and maintain the App and its features;
• Personalize your experience and deliver content tailored to your preferences;
• Process transactions and send you related information;

The App is not directed to children under the age of 13 (or 16 in the European Economic Area). We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us immediately.

2.7 Security

We implement commercially reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure.

2.8 Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes your acceptance of the revised policy.

3.1 Acceptance of Terms

By downloading, installing, or using the App, you confirm that you are at least 13 years of age (or 16 in the EEA), have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the App.

3.2 License to Use the App

Subject to these Terms, Easy Life Better LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial purposes. This license does not include the right to:

• Sublicense, sell, resell, transfer, or assign the App to any third party;
• Modify, translate, adapt, or create derivative works based on the App;
• Reverse engineer, decompile, or disassemble the App;
• Use the App for any commercial purpose without prior written consent;
• Remove any proprietary notices or labels on the App.

3.3 User Conduct

You agree not to use the App to:

• Violate any applicable local, state, national, or international law or regulation;
• Transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Engage in any activity that interferes with or disrupts the App or servers connected to it;
• Attempt to gain unauthorized access to any part of the App or its related systems.

3.4 Intellectual Property

The App and all its contents, features, and functionality, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Easy Life Better LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

"Easy Life Better", the Easy Life Better logo, and the slogan "Life made easy, in one snap" are trademarks of Easy Life Better LLC. You may not use these without prior written permission.

3.5 In-App Purchases

The App may offer in-app purchases. All purchases are final and non-refundable except as required by applicable law or as expressly stated in our refund policy. Prices are subject to change. All in-app purchase transactions are processed by Apple Inc. through the App Store and are subject to Apple's payment terms.

3.6 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EASY LIFE BETTER LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3.7 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EASY LIFE BETTER LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO EASY LIFE BETTER LLC IN THE TWELVE (12) MONTHS PRIOR TO THE CAUSE OF ACTION, OR $50 USD, WHICHEVER IS GREATER.

3.8 Indemnification

You agree to indemnify, defend, and hold harmless Easy Life Better LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

3.9 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be submitted to binding arbitration in Clovis, New Mexico, USA, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

3.10 Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, the license granted to you will immediately cease.

3.11 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page and/or by providing notice through the App. Your continued use of the App after the effective date of revised Terms constitutes your acceptance.

4.1 Distribution via Apple App Store

The Easy Life Better App is distributed through the Apple App Store, operated by Apple Inc. ("Apple"). These Terms constitute an agreement between you and Easy Life Better LLC only. Apple is not a party to these Terms. Apple has no obligation to furnish any maintenance or support services with respect to the App.

4.2 Acknowledgement of Apple's Role

You acknowledge and agree that:

• Apple has no responsibility whatsoever to furnish any maintenance and support services with respect to the App;
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App;
• Easy Life Better LLC, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including product liability claims, consumer protection claims, intellectual property infringement claims, and any other claims;
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

4.3 Compliance with Apple Guidelines

The Easy Life Better App has been developed in compliance with the Apple App Store Review Guidelines and all applicable Apple developer program license agreements. We are committed to maintaining this compliance through all future updates.

4.4 Usage Rules

Your use of the App is subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. Easy Life Better LLC represents and warrants that it has not and will not violate any third-party rights in providing the App.

4.5 Export Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
